The above referenced bills would encourage out of state women to come to New York for abortions by creating a cause of action should they be charged in another jurisdiction; shield New York abortion practitioners from arrest, subpoena, and extradition relating to abortion laws in other states; and prohibit professional misconduct and medical malpractice charges against abortion providers. The New York State Catholic Conference is strongly opposed to all of these pieces of legislation.
The Reproductive Health Act, passed in 2019, codified New York’s long-term standing as the most radical state in the country when it comes to abortion. The law legalized abortion on demand up until the moment of birth, decriminalized even forced or coerced abortions, and allowed non-physicians to perform surgical abortions. Since then, the legislature has sought new ways to expand the practice and place the burden of paying for it on New York taxpayers. This year, the state budget mandated that insurance carriers in the state provide coverage for abortion services, with virtually no conscience protections at all for religious organizations whose tenets teach that abortion is gravely wrong and the taking of a human life.
The New York legislature seems intent on responding to every state that acts on abortion by proposing bill after bill to expand and promote the practice here. On top of forcing all New Yorkers to support abortion through taxes and insurance premiums, they now seek to institute a sort of abortion tourism industry by inviting women from all over the country to terminate pregnancies in New York. This is an egregious affront to the millions of pro-life citizens who reject abortion and don’t want to fund these services for New Yorkers, much less those from across the country.
These are trying times. Uncertainty and instability brought on by the pandemic is making life difficult for mothers, parents, and families. New York should be focused on lifting up mothers in need, supporting women throughout pregnancy and into motherhood, and providing the necessary care for babies and children. The State should seek to assist women who might make a different choice, if they only had the necessary options and resources. Instead, the Governor allocates $35 million to encourage and promote abortion. The legislature continues to introduce bills that reject the choice they claim to promote. They showcase abortion as the only choice and demean women in doing so.
Legislation to protect abortion providers and promote New York as an abortion destination will hurt women. Expectant mothers deserve support. Promoting abortion as their only choice, and forcing New Yorkers to pay for it, is wrong. There is a better way forward for the women of New York and all over the country. We strongly urge you to reject these bills.
